REPUBLIC ACT NO. 9390

AN ACT CONVERTING THE MUNICIPALITY OF BOGO, CEBU PROVINCE INTO A COMPONENT CITY TO BE KNOWN AS THE CITY OF BOGO

ARTICLE I
GENERAL PROVISIONS

Section 1. Title. – This Act shall be known as the “Charter of the City of Bogo”.

Section 2. The City of Bogo. – The Municipality of Bogo is hereby converted into a component city to be known as the City of Bogo, hereinafter referred to as the City, which shall comprise the present territory of the Municipality of Bogo, Cebu Province.

The foregoing provision shall be without prejudice to the resolution by the appropriate agency or forum of existing boundary disputes or cases involving questions of territorial jurisdiction between the City of Bogo and its adjoining local government units: Provided, That the territorial jurisdiction of the disputed area or areas shall remain with the local government unit which has existing administrative supervision over said area or areas until the final resolution of the case.

Section 3. Corporate Powers of the City. – The City constitutes a political body corporate and, as such, is endowed with the attributes of perpetual succession and possessed of the powers which pertain to a municipal corporation to be exercised in conformity with the provision of this Charter. The City shall have the following corporate powers:

(a) To have a continuous succession in its corporate name;

(b) To sue and be sued;

(c) To have and use a corporate seal;

(d) To acquire, hold and convey real or personal property;

(e) To enter into any contract and/or agreement; and

(f) To exercise such other powers, prerogatives or authority subject to the limitations provided in this Act or laws.

Section 4. General Powers of the City. – The City shall have a common seal and may alter the same at pleasure. It shall exercise the powers to levy taxes; to close and open roads, streets, alleys, parks or squares; to take, purchase, receive, hold, lease, convey and dispose of real and personal property for the general interests of the City; to expropriate or condemn private property for public use; to contract and be contracted with; to sue and be sued; to prosecute and defend to final judgment and execution suits wherein the City is involved or interested in; and to exercise all the powers as are granted to corporations or as hereinafter granted.

Section 5. General Welfare Clause of the City. – The City shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare.

Within its territorial jurisdiction, the City shall ensure and support, among other things, preserve and enrich its culture, promote health and safety, enhance the right of the people to a balanced ecology, encourage and support the development of appropriate and self-reliant scientific and technological capabilities, improve public morals, enhance economic prosperity and social justice, promote full employment among their residents, maintain peace and order, and preserve the comfort and convenience of their inhabitants.

Section 6. Liability for Damages. – The City and its officials shall not be exempt from liability for death or injury to persons or damage to property.

Section 7. Jurisdiction of the City. – The jurisdiction of the City of Bogo, for police purposes only, shall be coextensive with its territorial jurisdiction and for the purpose of protecting and ensuring the purity of the water supply of the City, such police jurisdiction shall also extend over all the territory within the drainage area of such water supply, or within one hundred meters (100 m.) of any reservoir, conduit, canal, aqueduct or pumping station used in connection with the city water service.

The regional trial courts and the city courts of the City of Bogo shall have concurrent jurisdiction with the regional trial courts and the metropolitan trial courts or the city or municipal trial courts of the adjoining municipalities over crimes and misdemeanors committed within the said drainage area, or within an area of one hundred meters (100 m.).

The court first taking jurisdiction of such offense shall thereafter retain exclusive jurisdiction thereof. But any license that may be issued within the said zone, area or space shall be granted by the proper authorities of the city or municipality concerned, and the fees arising therefrom shall accrue to the treasury of the said city or municipality concerned and not to the City.

With 44 policemen in the City of Bogo, Mayor Martinez asked for military reinforcement to battle crime. The mayor sent his request through the army's 8th Infantry Division in Samar following the gun-slaying of three men which is believed to be related to illegal drug trade.


Martinez earlier asked for more policemen from the Cebu Provincial Police office but was told there was none to spare.
The military directed its 6th Company of the Special Forces (SF) assigned in Sogod, Cebu to assess the threat in the area first. - Read more: Cebu Daily News

Several bills passed by the House that seek to create more courts for the provinces of Laguna and Cebu and the city of Valenzuela has been approved by the Senate.
The passage of the measures into law is expected to lessen the backlog of cases in the Philippines, especially those in the provinces.
Sen. Francis Escudero, chair of the Senate committees on justice and human Rights, sponsored House Bill Nos. 4476, 4492, 4511 and 4513.
The bills were approved with 19 affirmative votes, zero negative vote and zero abstention. The bills were approved on second reading without amendments last July 31. - Manila Bulletin
Once enacted into law, seven RTC's will be created in the province of Cebu - one in Carcar, one in Naga and five will be created in Bogo City.

Bogo City's Barangay Cayang has been declared by the Department of Labor and Employment (DOLE) as child labor-free. Cayang is one of the two Barangays in Cebu to be declared as such.

The Ramon Aboitiz Foundation Inc. (RAFI) will hold the Run 2 Plant 4 Greenin Philippines 2012 on June 30, 2012 (Saturday).

The event will be held simultaneously in 51 municipalities and component cities(including Bogo City).


Run 2 Plant 4 GREENIN Philippines 2012 is organized in collaboration with the Cebu Provincial Government, Aboitiz Equity Venture, Department of Environment and Natural Resources, DILG, Talisay City local government unit and other LGUs in Cebu, and various government and private institutions.
Run 2 Plant 4 GREENIN Philippines, one of the components of GREENIN Philippines program, is a fun run and planting activity that provides a venue for every Filipino to contribute in rehabilitating and protecting our environment with the goal of bringing back the country’s forest cover.
GREENIN Philippines Program, which stands for Generation REdemption and Expansion of Natural resources INitiatives in the Philippines Program, is one of the programs under RAFI’s Integrated Development focus area. It aims to replicate best practices in environmental protection, conservation, and rehabilitation to more places in the country for a greener Philippines. The Pag-IBIG Fund (Home Development Mutual Fund) recently opened its new Service Center in the City of Bogo to bring its services closer to its members. 

During the opening, a total of 25 clients availed of the services (concerning printout of contributions, Multi–Purpose Loans, membership verification and receiving of Multi–Purpose Loan applications). The Bogo Service Center will also serve Pag-ibig members from in the municipalities of San Remigio, Tabuelan, Borbon, Tabogon, Medellin, Daanbantayan, Sta. Fe, Bantayan and Madridejos.

An earthquake occured past 12 midnight in Bogo City. PHIVOLCS reported that it was caused by tectonic movement in the sea near Barangay Siokon (source). No damage was reported and no aftershocks ensued because the tremor was too weak. Here are the seismic events as recorded by PHIVOLCS:

Message from the City Mayor

The City of Bogo celebrates its 5th year of cityhood. And yet, it seemed but only yesterdaythat we finally earned our right to be recognized as one. It was a recognition bitterly fought at the highest court of the land; it was a victory that, no doubt, is a major one.

But as far as we in the administration are concerned an even greater struggle is at hand: proving we can achieve the goals we had set in the first place when we pursued the dreams of cityhood. Rome was not built in a day, thus we are trying our best to fashion the tools of governance that wiull help in achieving the goals we had set for our city and our people.

We are fortunate our efforts in this direction have been recognized. The Department of the Interior and Local Government (DILG) has fiven the City of Bogo the Seal of Good Housekeeping. It is an award given to local government units in recognition of their good governance pratices for its efforts in the areas of Good Planning, SOund Fiscal Management, Transparency and Accountability, and Valuing Performance Management.

Of course, we still have a lot to do if we must grow at a pace consistent with real progress. In this regard we ask the cooperation and patience of our constituents. We give our assurance that, as the government agency charged with the supervision of local government units has recognized, the City of Bogo is doing its job. 

Hence, to all those who in one way or another have extended a helping hand so that Bogo may become what it is today and, more importantly, a true city of man that will be in the future, our sincerest gratitude and prayers.
