Most outstanding legislative council in the province for the component city category.

For its “ultimate contribution to the attainment of desirable socio–economic and environmental outcome” the Philippine Councilors League–Cebu Provincial Federation together with the Department of Interior and Local Government presented to the Bogo City Council the Local Legislative Award as winner in the Provincial Level for the component city category.

The award recognizes the exemplary performance of sanggunians, particularly of cities and municipalities, for legislating measures that help build the foundation of meaningful local administration and development. The award criteria includes eff ectiveness of the Legislative Agenda and the legislative tracking system, availability of legislative documents, efficiency of performance of the sanggunian, and quality of office set-up and staff complement.

Petron has announced that it has terminated its contracts with 21 of its service stations for selling substandard fuels and passing these off as having come from the petroleum company.

According to Petron, it ended its partnership with the said service stations over a 12-month period, from January 2012 to January 2013.

"It is our duty to make sure the consuming public only gets Petron's top-of-the-line fuel and lubricant products whenever they go to a Petron station," said Petron vice president for national sales Archie Gupalor. "We do not tolerate these illegal activities and we will continue to go after unscrupulous dealers within our network to ensure the integrity of the Petron brand."

To prove that it is serious in going after these erring dealers, Petron recently filed criminal charges against a dealer in Bogo City, Cebu. For its part, the Bogo City Prosecutor's Office found probable cause with Petron's allegations that the dealer committed criminal acts of trademark infringement, unfair competition, and false designation of origin, all of which are punishable under Republic Act 8293, also known as the "Intellectual Property Code of the Philippines."

At least eight buses of the Metro Cebu Autobus Corporation were suspended for one month by the Land Transportation Franchising and Regulatory Board 7 starting Tuesday.

LFTRB-7 Regional Director Ahmed Cuizon announced the suspension after a meeting with company officials yesterday.



Last Monday an Autobus unit collided with an oncoming Toyota Altis sedan in the national highway in Bogo City in north Cebu. Three bus passengers were killed and 37 were injured, including both drivers.

The suspended buses are listed in the same franchise number of the bus that figured in the accident.
Cuizon said Autobus units covered by other franchises can still operate.

Autobus operates a fleet of more than 30 buses.

“We just want to uphold public safety. We want to be sure that the riding public is safe, especially now that it is passenger season because of Christmas,” Cuizon said.

Based on police investigation the bus “was just a second party to the accident” as it was the private car that rammed it but “the suspension is standard operating procedure,” Cuizon said.

comelec logo - sealThe Commission on Elections (Comelec) en banc has rejected the request of Rep. Benhur Salimbangon (Cebu, 4th district) to place Bogo City in northern Cebu under Comelec control in the 2013 elections to prevent a repeat of the stand-off in Pulambato in 2010.
Comelec Chairperson Sixto Brillantes said the Comelec, as a collegial body, decided that placing Bogo City under Comelec control is unnecessary and has no basis.
Brillantes said the Comelec decision is final.
Earlier, Salimbangon said placing Bogo City under Comelec control will prevent violence in the elections, especially that there are armed men in the area who are freely roaming around.
Salimbangon said he wants clean and honest elections and placing Bogo City under Comelec control will prevent criminals from making trouble during the campaign period and on election day.
Bogo City Mayor Celestino “Junie” Martinez Jr. said he is happy to learn about the Comelec order, saying the congressman’s suggestion is selective.
“Benhur might have thought that because Brillantes was their lawyer in the 2010 election, he can again take advantage now that Brillantes is the Comelec chairman,” Martinez said.
He said it’s not good for Salimbangon to suggest only Bogo City for Comelec control when there are more troubled towns in the fourth district, such as Daanbantayan, Tabuelan, Sta. Fe, San Remigio and Madridejos.
Instead of Comelec control, Martinez suggested the creation of a credible group composed of religious, civic and media leaders to oversee the elections in the entire fourth district.
“I think that if created, this group from the religious, civic and media sectors will be respected by all political leaders and their followers because they are non-partisan and whose only motive in monitoring the fourth district is to ensure a clean and honest elections,” Martinez said.

Brillantes said the situation should be grave enough to warrant the commission’s control.
”Kung marami na hong namamatay dyan, nag-bombahan na, nag-iitsahan na ng granada, nagsusuguran na, maraming loose firearms, nagbabarilan na dyan. Wala nang peace and order. That is the time we place it under Comelec control. Is that the situation?” Brillantes said in an interview in Atty. Frank Malilong’s TV 5 program “Frankahay Ta.”

Mayor Junie Martinez said they only suggested that the entire district be placed under Comelec control with conditions after Salimbangon suggested that Bogo be placed under the commission’s control.
”Salimbangon wants only Bogo declared, so I said, ‘Why not the entire district?” Junie said.

Comelec Provincial Supervisor Lionel Marco Castillano told Cebu Daily News last Friday that placing an area under Comelec control is considered a last resort.
“It is the Comelec en banc who will make the decision and the creation of the special task force who will oversee the Comelec controlled area,” he said.

THREE towns and one city in Cebu province towns are being closely monitored by government security agencies to prevent possible political violence.

Although not yet considered election hotspots, the Joint Security and Peace Coordinating Conference (JPSCC) is taking a close watch especially in the fourth district in northern Cebu.

The 4th district is hotly contested between the Martinez and Salimbangon political clans. Danao City is being hotly contested by the divided Durano clan.

"THE Bogo city government is asking the Cebu Ports Authority to help fund the expansion of the Polambato Roll-on and Roll-off Port as part of efforts to spur economic growth.

The city government trying to carve out a ‘business district’ out of vast sugarcane fields in barangay Cayang.

This will be completed in December or early January next year, said Mayor Celestino “Junie” Martinez, Jr, during the 888 News Forum held offsite in the northern city yesterday.

The site will also host Bogo’s new City Hall and will have an entertainment area."

REPUBLIC ACT NO. 9390

AN ACT CONVERTING THE MUNICIPALITY OF BOGO, CEBU PROVINCE INTO A COMPONENT CITY TO BE KNOWN AS THE CITY OF BOGO

ARTICLE I
GENERAL PROVISIONS

Section 1. Title. – This Act shall be known as the “Charter of the City of Bogo”.

Section 2. The City of Bogo. – The Municipality of Bogo is hereby converted into a component city to be known as the City of Bogo, hereinafter referred to as the City, which shall comprise the present territory of the Municipality of Bogo, Cebu Province.

The foregoing provision shall be without prejudice to the resolution by the appropriate agency or forum of existing boundary disputes or cases involving questions of territorial jurisdiction between the City of Bogo and its adjoining local government units: Provided, That the territorial jurisdiction of the disputed area or areas shall remain with the local government unit which has existing administrative supervision over said area or areas until the final resolution of the case.

Section 3. Corporate Powers of the City. – The City constitutes a political body corporate and, as such, is endowed with the attributes of perpetual succession and possessed of the powers which pertain to a municipal corporation to be exercised in conformity with the provision of this Charter. The City shall have the following corporate powers:

(a) To have a continuous succession in its corporate name;

(b) To sue and be sued;

(c) To have and use a corporate seal;

(d) To acquire, hold and convey real or personal property;

(e) To enter into any contract and/or agreement; and

(f) To exercise such other powers, prerogatives or authority subject to the limitations provided in this Act or laws.

Section 4. General Powers of the City. – The City shall have a common seal and may alter the same at pleasure. It shall exercise the powers to levy taxes; to close and open roads, streets, alleys, parks or squares; to take, purchase, receive, hold, lease, convey and dispose of real and personal property for the general interests of the City; to expropriate or condemn private property for public use; to contract and be contracted with; to sue and be sued; to prosecute and defend to final judgment and execution suits wherein the City is involved or interested in; and to exercise all the powers as are granted to corporations or as hereinafter granted.

Section 5. General Welfare Clause of the City. – The City shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare.

Within its territorial jurisdiction, the City shall ensure and support, among other things, preserve and enrich its culture, promote health and safety, enhance the right of the people to a balanced ecology, encourage and support the development of appropriate and self-reliant scientific and technological capabilities, improve public morals, enhance economic prosperity and social justice, promote full employment among their residents, maintain peace and order, and preserve the comfort and convenience of their inhabitants.

Section 6. Liability for Damages. – The City and its officials shall not be exempt from liability for death or injury to persons or damage to property.

Section 7. Jurisdiction of the City. – The jurisdiction of the City of Bogo, for police purposes only, shall be coextensive with its territorial jurisdiction and for the purpose of protecting and ensuring the purity of the water supply of the City, such police jurisdiction shall also extend over all the territory within the drainage area of such water supply, or within one hundred meters (100 m.) of any reservoir, conduit, canal, aqueduct or pumping station used in connection with the city water service.

The regional trial courts and the city courts of the City of Bogo shall have concurrent jurisdiction with the regional trial courts and the metropolitan trial courts or the city or municipal trial courts of the adjoining municipalities over crimes and misdemeanors committed within the said drainage area, or within an area of one hundred meters (100 m.).

The court first taking jurisdiction of such offense shall thereafter retain exclusive jurisdiction thereof. But any license that may be issued within the said zone, area or space shall be granted by the proper authorities of the city or municipality concerned, and the fees arising therefrom shall accrue to the treasury of the said city or municipality concerned and not to the City.
